1. Ordering:
Goods are sourced/manufactured and printed/embroidered to your instructions. A
verbal order is legally binding but you are asked to confirm your order in
writing by fax or email with email being the preferred method.
2. Delivery Time:
Standard stock items are normally printed or embroidered and despatched within
2-3 working days of order confirmation depending on complexity of order.
For
one off orders the dispatch time is 2-3 days.
For custom orders the
delivery is usually between 10-15 days, but depends on the complexity of the
design and stock availability.
Bespoke items are manufactured, printed/embroidered and despatched within the
manufacturers quoted lead times which will be outlined during the order process.
These vary depending on the manufacturer and garments involved.
3. Samples:
Samples which are manufactured for you and/or printed or embroidered: if no
order is made, artwork, set-up, production and delivery costs will be charged.
Unprinted samples of items: these must be returned at your cost and risk
to avoid incurring an invoice.
Imprint Size
The imprint size will be noted on the design mockup. Designs will be sized for
the smallest sized garment within an order. Ex: An order contains both youth
and adult sized garments that are to receive the same imprint. The imprints
will be sized for the smallest youth sized garment.
Imprint Placement
The imprint placement will be specified on the sales order and design mockup.
Precise location will slightly differ on each garment.
4.
Colour Variations
Due to the limitations of desktop scanners and the relative inconsistencies of
various display monitors, the colours you see on your screen may not be a
totally accurate reproduction of the actual product. We strive to make our
colours as accurate as possible, but screen images are intended as a guide only
and should not be regarded as absolutely correct.
5.
Payment Terms:
A guideline price list is available on request for the most popular items. We
realise most orders are unique and will be priced once your requirements,
including printing/embroidery are known. As stated on the written quotation you
will receive, these prices will be valid for 30 days from the date of the
quotation.
We require that all custom orders under £500 be pre-paid. We require a 50%
deposit on custom orders over £500. The remaining 50% balance must be paid upon
completion/within 30 days if you have an account with us.
6.
Garment Care:
Great care is taken to source the highest quality products, fabrics (garments)
and materials (print and embroidery) to suit your needs. Incorrect washing can
cause damage. To get the best results follow the washing instructions. In
general when colours are mixed and garments are printed & numbered - do not
boil or tumble dry - do not iron on print.
Please follow these garment care instructions to make sure you get the best out
of your garment. Most items can be washed to up to 30o C. We recommend not to
Tumble Dry. When you receive your item we recommend to give it a
wash first as there might be left over pre-treatment on the garment. This is
not toxic but does affect the colour shine of the garment (Only applicable to
DTG printed garments). Take care when ironing, medium heat and turn the garment
inside out, but never put print on print.
7.
Change Orders
We do accept changes in placed orders, but if the order has already gone into
production then payment in full must be made for the produced garments.
8.
Faults and Returns:
We are confident that you will be delighted
with your purchase. If, however, you are not completely satisfied, we offer a
14 Day Returns Policy. You can return your item(s) to us within 14 working days
of delivery for exchange or refund. Your statutory rights are not
affected.
Genuine faulty returns will be replaced or credited. Please you the
return link at the bottom of the home page.
Goods ordered incorrectly (with personalised embroidery or print) will not be replaced
or credited.
Goods you have washed incorrectly or damaged by usage will not be replaced or
credited.
9. Delivery:
Delivery will be made as soon as possible after your order is ready for
dispatch, and to the address you give us for delivery at the time you make your
order.
You will become the owner of the goods you have ordered when they have been
delivered to you and you have paid in full for them, until such time any goods
will remain the property of LAH Fabrics. Once goods have been delivered
to you they will be held at your own risk and we will not be liable for their
loss or destruction.
Delivery of product will be charged according to size and weight and will
usually be made via a recognized courier company, unless otherwise stated.
Any shortage or non-delivery must be notified in writing within three days.
10.
Accounts
All prices subject to confirmation when you order.
Orders over £500 are payable on order and orders over £500 require a 50%
deposit of invoice amount payable on order, and balance on delivery.
Accounts may be settled by PayPal, Cash, Cheque (payable to LAH Fabrics), BACS
transfer or Card payment. If a credit card is used then a surcharge may be made
to cover the costs of charges made to us.
11.
Retention of Title:
Until full payment has been made the goods remain the property of LAH Fabrics
and we reserve the right to withhold delivery or to reclaim the goods in the
event of non-payment.
12.
VAT
We are not VAT registered.
13. Cancellation by you
To cancel your order you must notify us in writing.
You cannot cancel your order if the goods you have ordered have been printed or
embroidered or manufactured specifically for you.
If we have already dispatched goods to you, you must send them back to us at
your own cost and risk. If we return stock items to wholesalers, we will
pass on any re-stocking charge.
14. Cancellation by us
We reserve the right to cancel the contract between us if we cannot obtain the
stock to fulfil your order.
If we do cancel your contract we will notify you by email and will re-credit to
your account any sum received by us from you as soon as possible but in any
event within 30 days. We will not be obliged to offer any additional
compensation for disappointment suffered.
15. Liability
If the goods we deliver are not what you ordered or are damaged or defective or
the delivery is of an incorrect quantity, we shall have no liability to you
unless you notify us in writing within 14 working days of the delivery of the
goods in question.
If you do not receive goods ordered by you we shall have no liability to you
unless you notify us in writing within 14 days of the date on which we advised
they would be dispatched.
Our only obligation will be, at your option:
• to make good any shortage or non-delivery;
• to replace or repair any goods that are damaged or defective; or
• to refund to you the amount paid by you for any goods that are damaged or
defective
Save as precluded by law, we will not be liable to you for any indirect or
consequential loss, damage or expenses, and we shall have no liability to pay
any money to you by way of compensation other than to refund to you the amount
paid by you for the goods in question.
Notwithstanding the foregoing, nothing in these terms and conditions is
intended to limit any rights you might have as a consumer under applicable
local law or other statutory rights that may not be excluded nor in any way to
exclude or limit our liability to you for any death or personal injury
resulting from our negligence.
16. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have
ordered or any delay in doing so or for any damage or defect to goods delivered
that is caused by any event or circumstance beyond our reasonable control
including, without limitation, strikes, lock-outs and other industrial
disputes, breakdown of systems or network access, flood, fire, explosion or
accident.
17. Rectification of these
Terms
If any of these terms, or
any part of these terms, is unenforceable or void in law, it shall not affect
the remainder of such terms or any other such term or otherwise affect the
contract and shall be replaced by such valid term as is near as may be in effect
to the original term.
18. Jurisdiction
All contracts between the
Company and the Customers shall be governed by the laws of England and Wales.
Any disputes arising there from shall be the subject to the jurisdiction of the
English courts.
19. Intellectual Property
Rights
The Customer will
indemnify the Company from and against all costs, claims, liabilities and
damages which we may suffer or incur as a result of you using, reproducing or
exploiting any industrial or intellectual material or property rights without
the consent of the proprietor.
The copyright to all
content on this website including applets, graphics, images, layouts and text
belongs to us or we have a licence to use those materials.
All trade marks, brands
and logos generally identified either with the symbols TM or ® which are used
on this website are either owned by us or we have a licence to use them. Your
access to our website does not license you to use those marks in any commercial
way without our prior written permission.
Any comment, feedback,
idea or suggestion (called “Comments”) which you provide to us through this
website becomes our property. If in future we use your Comments in
promoting our website or in any other way, we will not be liable for any
similarities which may appear from such use. Furthermore, you agree that
we are entitled to use your Comments for any commercial or non-commercial
purpose without compensation to you or to any other person who has transmitted
your Comments.
If you provide us with
Comments, you acknowledge that you are responsible for the content of such
material including its legality, originality and copyright.
20. Disclaimers
Whilst we have taken all
due care in providing the information on our website, we do not provide any
warranty either express or implied including without limitation warranties of
title or implied warranties of merchantability or fitness for a particular
purpose.
To the extent permitted by
law, any condition or warranty which would otherwise be implied into these
terms and conditions is excluded.
We also take all due care in ensuring that our website is free of any virus, worm, Trojan horse and/or malware, however we are not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.
